RULES OF AUCTION

-Time and Venue:  25th June 2011, 10:00, at 8 Boldcon Street, Strand.

-These rules comply with section 45 of the Consumer Protection Act, 2008 (Act 68 of 2008) and each lot is, unless there is evidence to the contrary, regarded to be the subject of a separate transaction.
-The auction will commence at the published time and will not be delayed to enable specific persons in general to take part in the auction.
-A person who attends at the auction to bid on behalf of another person must produce a letter of authority meeting the requirements of regulation 26(3) in order to so bid on behalf of that person.
-The auctioneer has a trust account into which all moneys will be paid for the benefit of the seller, minus the agreed costs and commission.
-The reason for the auction is the normal and voluntary disposal of goods by the owner.
-A person who intends to bid must register prior to bidding as contemplated in regulation 26(2) and FICA requirements require a copy of ID and proof of address of the bidder.
-The bidders record and the vendor roll are available for inspection during normal hours without the charge of a fee.
The highest accepted bidder shall be the purchaser.
-The auctioneer has the right to regulate the bidding and the sale by auction is subject to the auctioneer’s and /or his staff’s right to participate in the auction by bidding openly.
-The sellers have permitted the auctioneer to remove and or withdraw any item or lot at any time from the auction.
-Lots or items which are offered at a reserve will be indicated by the auctioneer as such.
-The auctioneer does not hold himself responsible for any errors of description.
-A bid shall be taken as proof the bidder has made himself / herself acquainted with the condition for lots for which he / she bids.
-All goods are sold voetstoots (As Is)
-Lots knocked down remain at the risk of the purchaser.
-Items not specifically listed and indicated as with a reserve price, will be auctioned without reserve. -No goods may be removed until paid for. -Terms: Bank transfers (EFT) or bank guaranteed cheques.
-All sales are final.
-Advertising cost will not be added to the account of bidders.
-Buyers commission will be charged by the auctioneer at a rate of 12.5% of the bid price of successful bidders/purchasers. Such commission will be added to the account of the purchasers.
